These Terms of Use govern the use of the Spot Scout application (the "App") and its associated website and services. The provider is Spot Scout UG (haftungsbeschränkt); full provider details are set out in the Legal Notice.
By registering for or using the App, you agree to these Terms of Use. Any conflicting terms of the user do not become part of the agreement unless the provider expressly agrees to them in writing.
Spot Scout is a platform for discovering, creating and sharing places, events and tours. The provider supplies the technical infrastructure but gives no warranty as to the accuracy, completeness or timeliness of user-generated content. There is no entitlement to any particular set of features; features may be developed further, changed or discontinued.
Most features require a user account. The information provided during registration must be truthful and complete. Access credentials must be kept confidential and must not be shared with third parties. Registration is permitted for natural persons aged 16 and over; younger persons require the consent of their legal guardians. As a rule, each person may hold only one account.
When using the App, you must in particular refrain from:
You remain responsible for content you submit (text, images, places, events) and warrant that you hold the necessary rights. You grant the provider a non-exclusive, worldwide, perpetual, royalty-free right to store, technically process (e.g. resizing images), display and make available to other users such content for the purpose of operating and promoting the App. The provider may remove or block content that violates these terms or applicable law.
Points, ranks and similar elements serve solely for entertainment and motivation. They have no monetary value, are not transferable and cannot be paid out. The provider may correct point balances that result from abuse or technical errors.
The provider endeavours to operate the service with as little disruption as possible but does not owe any particular level of availability. Maintenance work, technical faults or circumstances beyond the provider's control may lead to temporary limitations.
The provider is liable without limitation for intent and gross negligence, as well as under the German Product Liability Act and for injury to life, body or health. In cases of simple negligence, the provider is liable only for the breach of a material contractual obligation (cardinal obligation) and limited in amount to the foreseeable damage typical for this type of contract. Liability is otherwise excluded. No liability is accepted for user-generated content or for the content of linked external sites.
Use of the App is free of charge and may be ended by you at any time by deleting your account. The provider may terminate the usage relationship with reasonable notice and may block or delete accounts in the event of serious or repeated breaches of these terms.
The provider may amend these Terms of Use with effect for the future where this is necessary for legal or technical reasons or in order to adapt the range of services. Material changes will be announced in good time. If you continue to use the App after the changes take effect, the amended terms are deemed accepted.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the state in which the user has their habitual residence remain unaffected. Should any provision of these Terms of Use be invalid, the validity of the remaining provisions shall remain unaffected.
